Terms of Service

The service

kevinsomany.com publishes articles on AI engineering and related topics. Some sections of articles and projects are available only to paid members ("premium content"). A membership subscription unlocks those sections across the site.

Billing, auto-renewal, and taxes

Memberships are billed at THB 299 per month (monthly plan) or THB 2,990 per year (annual plan). Prices are in Thai baht. Any applicable VAT or other tax is calculated by Polar at checkout based on your billing country and is shown before you confirm your purchase.

Subscriptions renew automatically at the end of each billing period. Polar will charge your selected payment method on each renewal date until you cancel. The subscription amount and renewal frequency are shown at checkout and in your receipt.

Cancellation

You may cancel at any time through the Polar customer portal, accessible from your account page via the "Manage billing / cancel" button. No cancellation fee applies.

Cancellation takes effect at the end of your current billing period. You retain access to members-only content until that date. No prorated refund is issued for the remaining days of a billing period unless you exercise a statutory withdrawal or cooling-off right as described below.

Right of withdrawal (EU, EEA, and UK consumers)

If you are a consumer resident in an EU or EEA member state or in the United Kingdom, you have a statutory right to withdraw from this contract within 14 days of purchase without giving any reason.

This subscription grants immediate access to digital content. By completing a purchase you expressly request that performance begin before the withdrawal period expires, and you acknowledge that you lose the right of withdrawal once the digital content has been made available, as permitted by EU Directive 2011/83/EU Art.16(m) and UK Consumer Contracts Regulations 2013 reg.37.

If you have not yet accessed any members-only content, you may still exercise the right of withdrawal within 14 days by contacting k3v1n@arisadesiam.com. See the Refund and Cancellation Policy for how to request a refund.

Cooling-off period (Thailand)

Under Thailand's Direct Sales and Direct Marketing Act B.E. 2545 (ss.33, 36), consumers resident in Thailand have the right to cancel this contract within 7 days of purchase and to receive a full refund within 15 days. See the Refund and Cancellation Policy for details.

Acceptable use

You may use members-only content for personal, non-commercial reading and learning only. You may not share your account credentials, redistribute members-only content to third parties, resell access, or circumvent any technical access controls on the site.

Intellectual property

All content on kevinsomany.com, including articles, code samples, images, and design elements, is owned by The Checklist Co. Ltd. or licensed to it and is protected by applicable intellectual property laws.

A membership grants you a limited, personal, non-transferable, non-sublicensable licence to access and read members-only content during your active subscription period. No other right or licence is granted.

The service is provided on an "as is" and "as available" basis. We do not warrant that the service will be uninterrupted, error-free, or meet your specific requirements.

Limitation of liability

To the maximum extent permitted by applicable law, The Checklist Co. Ltd. is not liable for any indirect, incidental, special, or consequential loss or damage arising from your use of or inability to use the service.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

Governing law

These Terms are governed by the laws of the Kingdom of Thailand. Any dispute arising under or in connection with these Terms shall be subject to the non-exclusive jurisdiction of the courts of Thailand.

If you are a consumer resident in the European Union, the European Economic Area, or the United Kingdom, you retain the benefit of any mandatory consumer protection provisions that apply under the law of your country of residence and that cannot be excluded or varied by contract. Nothing in this clause limits those rights.

Changes to these Terms

We may update these Terms from time to time. If we make material changes we will notify you by email or by posting a prominent notice on the site at least 14 days before the changes take effect.

Your continued use of the service after the effective date constitutes acceptance of the revised Terms. If you do not agree to the revised Terms you may cancel your subscription before the changes take effect.
